For Senders
These Terms govern your use of the Dyspatch website and app to send and track packages, operated by [Dyspatch Legal Entity Name] (“Dyspatch”, “we”, “us”), a company registered in Nigeria [(RC [NUMBER])] at [Registered Address]. By sending a package, tracking a delivery, or creating a personal account, you agree to these Terms. If you do not agree, do not use the Platform.
1. What Dyspatch is
Dyspatch is a last-mile delivery marketplace. We connect senders with independent riders who carry out deliveries. We provide the technology — we are not a courier and we do not employ riders. Riders operate independently under a separate Rider Agreement.
2. The service
You can request a delivery, see a fixed fare before you confirm, get matched to the nearest verified rider, and track the delivery live from pickup to drop-off, secured by a one-time handover code. We currently operate in Lagos and Benin City, with zones shown on the Platform, which we may change at any time.
3. Eligibility and accounts
You must be at least 18 and able to enter a binding contract. You do not need an account to send or track a single package. An account is optional and lets you save addresses, view history and reorder. If you create one, keep your credentials secure, give accurate information, and tell us at support@dyspatch.com if you suspect unauthorized use. You are responsible for activity under your account.
4. Sending a package
When you create a delivery request, you confirm that: the pickup, drop-off and package details are accurate; you are entitled to send the item and it complies with the law; it contains no prohibited item (clause 7); and someone will be available to hand it over and, where needed, receive it. You are responsible for adequate packaging. We or the rider may refuse, cancel or return a package that appears unsafe, unlawful or not ready.
5. Tracking and the handover code
Each delivery has a unique tracking link that works in any browser without logging in — treat it as sensitive and share it only with those who need it; it may expire after completion. Each delivery is secured by a one-time handover code (OTP): the clock starts only when the code is confirmed, the code expires after 30 minutes, and it locks after three failed attempts. Share the correct code only with the intended party at handover.
6. Fares and payments
The fare is shown before you confirm and is then fixed for that delivery unless you change the request or it materially differs from what you described. You may pay per delivery, or from a wallet if you hold an account, by card or transfer through our processors (for example Paystack or Flutterwave), whose terms also apply. We do not store full card details. We may charge disclosed service fees.
7. Cancellations, failed deliveries and refunds
You may cancel free of charge before a rider is matched; after matching or once en route, a cancellation fee may apply. If a delivery fails through no fault of ours (no one available, wrong address, access refused), the fare may remain payable. Where it fails due to a Platform fault, we refund or re-run it. Refunds go to your wallet or original payment method.
8. Prohibited items and acceptable use
You must not send, or attempt to send: illegal drugs or controlled substances; weapons, ammunition or explosives; hazardous or dangerous materials; stolen goods; live animals or human remains; cash beyond any stated limit; or anything prohibited by Nigerian law. You must not provide false information, use the Platform unlawfully, disrupt it, or access systems without authorization. We may suspend accounts and report attempts to move prohibited goods.
9. Package protection and value
You must accurately describe, and where asked declare the value of, what you send. Any package protection we offer, and its limits, are described on the Platform and apply only where you followed the requirements. Unless expressly stated, Dyspatch does not act as an insurer. 10. Ratings and conduct
You may rate a delivery. Treat riders with respect; do not harass, threaten, discriminate against or endanger anyone. We may remove abusive, false or unlawful content.
11. Intellectual property
The Platform and its software, design, brand and content belong to Dyspatch or its licensors. You get a limited, non-exclusive right to use it for its intended purpose; you may not copy, modify, resell or reverse-engineer it except as the law allows.
12. Data and privacy
We handle your personal data under our Privacy Policy for Senders and the Nigeria Data Protection Act 2023 and NDPR. Please read it — it explains what we collect (including the recipient details you provide and delivery location) and your rights.
13. Disclaimers and limitation of liability
We work to keep the Platform reliable but do not guarantee uninterrupted, timely or error-free operation; ETAs are estimates, not guarantees. To the fullest extent permitted by law, we are not liable for delays, loss or damage caused by your inadequate packaging or mis-declaration or by third parties, or for indirect or consequential loss. Nothing excludes liability that cannot lawfully be excluded (including for death or personal injury caused by our negligence, or fraud). Where our liability can be limited, it is limited to [the fee paid for the delivery in question — confirm with counsel].
14. Indemnity
You will indemnify Dyspatch against claims and costs arising from your breach of these Terms, misuse of the Platform, or attempt to send a prohibited or unlawful item.
15. Suspension and termination
We may suspend or terminate access where you breach these Terms, act fraudulently or unlawfully, or compromise Platform security. You may stop using the Platform anytime and delete any account in settings; some data may be retained as required by law (see the Privacy Policy).
16. Governing law and disputes
Governed by the laws of the Federal Republic of Nigeria. We will both try to resolve disputes in good faith first; failing that, [courts of [State] / arbitration in [State] under the Arbitration and Mediation Act 2023 — choose one with counsel].
17. Changes to these terms
We may update these Terms and will post the new version with a new effective date. Continued use after changes means you accept them.
